Vendors are expected to meet certain criteria before transacting on the platform. However, for the avoidance of any doubt, boomyaga does not represent neither the vendor nor the buyer, neither do we organize, control nor are we liable nor responsible for the quality, safety, lawfulness or availability of the products or services offered by the vendors for sale on the sites. Boomyaga is also not responsible for the ability of the vendors to complete a sale or the ability of buyers to complete a purchase.

Every person accessing or using our sites or services accepts the risks of performing any acquisition and sale transactions thus we encourage you to use various means to evaluate whom you are transacting with.

Affirmation/Warranty

By advertising or posting an item or a product, you guarantee and represent that (a) you are the owner of a product or license, or that the right owner of such product or license has granted you permission to use such product/license in a manner consistent with the purpose of your use and is as permitted by this terms of use and service, (b) that any person portrayed in Images, if any, has provided consent to the use of such Images as set forth in this terms of use.

Boomyaga Rights

>We reserve the right to observe every content on our site, to ascertain there is conformity with our rules and this Terms, as well as to comply with any principle, rule, law, regulation or authorized government demands. Boomyaga maintains the right in its sole discretion to edit, reject or remove any information or item submitted to or posted on our site. Without limiting the above mentioned, we shall have the right to remove any content that we in our sole discretion, find to be in contravention of this terms or which are objectionable.

Payment

Vendor agrees that goods receivable by the buyer are as represented on the site. They also agree that for every purchase of the vendor’s goods/products made in this site, they will make the goods available within 24 hrs of request for delivery and will receive their payment through boomyaga in 48/72hrs, less of boomyaga’s commission and applicable tax.

Boomyaga reserves the right to review the commission percentage, which will be communicated to the vendors 7 days before the review takes effect.

Indemnification

In the event of a contractual disagreement or dispute with any party in connection to a transaction conducted on this site, you agree to release and indemnify us, our agents, affiliates, licensors, team, directors, officers and employees from all claims, demands, actions, proceedings, costs, expenses and all damages (including reasonable attorney’s fees).

You also agree that you guarantee and indemnify us and our partners, associates, affiliates, employees and team against claims (which include reasonable legal fees) and risks incurred as a result of your act or omission which include, but are not limited to:

Misrepresentation of items, merchandise, products and services, deceitful designs and plans, counterfeit and substandard products, inability to meet specifications, including relevant and applicable government specifications, unsafe, illegal or prohibited products, delay or failure to deliver or pay/refund, charge inaccuracies, violation of agreement/contract or service, haulage accidents and every third party rights.

These claims and risks also include, petitions, claims and demands from customers, purchasers, end-users of products or other third parties who claim to have suffered harm or damage from their use of the items or products obtained through the sites or services.

Vendors and consumers on the Sites are solely accountable for the implementation of the terms and conditions of all transactions conducted on or through the use of the sites or services. And Boomyaga reserves the right to withdraw its features/services at anytime without recourse or liability to you or any third party.
